«Conciliation in criminal proceedings

The scientific and practical conference «Conciliation in criminal proceedings: methodological and applied aspects in the context of new priorities of the legal policy of the Republic of Kazakhstan in the context of the 2017 constitutional reform» will be held on 7 December 2018, at Abai Kazakh National Pedagogical University.

The discussed issues:

1.Criminal and legal principles of the procedural agreement;

2.Problems of a criminal procedure regulation of conciliation proceedings;

3.Problems of an institutionalization of the procedural agreement;

4.Features of a regulation of the transaction about recognition of fault and prospect of improvement of the criminal procedure legislation;

5.Features of a regulation of the procedural cooperation agreement and prospect of improvement of the criminal procedure legislation;

6.Features of judicial review of criminal cases on which the procedural agreement is concluded;

7.Respect for the principles of justice in the context of the procedural agreement;

8.A role and value of the prosecutor in conciliatory production;

9.Subjects of legal relationship in the conditions of the procedural agreement - a regulation of their legal status;

10.A proof subject of criminal cases on which the procedural agreement is concluded;

11.The place and a role of the defender on criminal cases on which the procedural agreement is concluded;

12.Problems of operational search support of the procedural cooperation agreement;

13.Practice of application by criminal prosecution authorities of the procedural agreement, mediativny agreement;

14.A ratio of concepts - «the mediativny agreement», «the accelerated production» and «the reduced production»;

15.Foreign experience of application of institute of the procedural agreement and its use in improvement of the criminal procedure legislation of Kazakhstan.
