Announcement on the competition of property rent

1. Name of the organizer:

NJSC "Kazakh National Pedagogical University named after Abai" (hereinafter referred to as the University) announces a competition for the transfer of the dining rooms of the University for property lease, with ongoing repairs and full equipment (furniture, kitchen utensils, equipment, etc.) by a potential tenant , with a lease term of up to three years from the calculation of the costs incurred for current repair work and equipping of dining rooms, in accordance with subparagraph 5) of paragraph 2 of Article 546 of the Civil Code of the Republic of Kazakhstan, in the form of payment for imposing on the tenant the costs stipulated by the contract to improve the leased property.

2. Conditions and procedure for the competition:

The conditions and procedure for holding the competition are regulated by the Regulations on the conditions and procedure for the transfer of property of NJSC "Abai Kazakh National Pedagogical University" to property lease. The application form for participation in the competition is available on the Company`s website.

3. Qualification requirements for the participant of the competition:

To participate in the competition to determine a potential employer, he must meet the following general qualification requirements:

3.1. have legal capacity;

3.2. be solvent, not have a tax debt exceeding six times the amount of the monthly calculation index established for the corresponding financial year by the law on the republican budget and effective as of January 1 of the corresponding financial year;

3.3. have the financial and (or) material and (or) labor resources necessary to fulfill obligations under the contract of employment;

3.4. not be subject to the procedure of bankruptcy or liquidation of its property, it must not be seized, its financial and economic activity must not be suspended in accordance with the legislation of the Republic of Kazakhstan;

3.5. founders, heads of a potential employer should not be included in the list of organizations and persons associated with the financing of terrorism and extremism in the manner prescribed by the legislation of the Republic of Kazakhstan;

3.6. should not be included in the register of unscrupulous participants in public procurement;

3.7. have experience in the catering industry.

6. Date and place of the competition (opening of envelopes submitted by participants): 11.00 am on July 4, 2023, Republic of Kazakhstan, Almaty city, Dostyk avenue, 13, office No. 307.

7. Deadlines and place for accepting applications for participation in the competition:

Applications are accepted from June 16, 2023 to July 03, 2023, from 10:00 to 17:00 at the address Republic of Kazakhstan, Almaty city, Dostyk avenue, 13, office No. 218.

8. The term of the current repair work and equipment of the object of employment is: current repair work and equipment must be carried out before the start of the educational process, namely until September 1, 2023. The tenant, who duly performed his duties, has, upon completion of the current repair work, all other things being equal, the right to conclude a property lease agreement for an additional leased object over other persons.

9. List of documents required for participation in the competition:

The following documents must be attached to the application of a potential employer:

1) the original application for participation in the tender for the provision of property for lease of property in the form in accordance with Appendix 1 to this tender documentation, signed and sealed (if any);

2) signed and stamped (if any) by the potential participant the original price offer for the object of the competition or for the lot (within the framework of one competition for each lot, the original of a separate price offer is issued if the potential participant participates in several lots of this competition).

The following documents must be submitted:

for individuals:

- a copy of the identity document of the participant;

- a copy of the document on registration as a business entity (if an individual is a business entity);

- a copy of the certificate of the absence of tax debts at the time of filing the application, issued no earlier than one month preceding the date of opening the envelopes with competitive bids (if the person is a business entity);

- a copy of permits/licenses to carry out the target type of activity at the facility (if this type of activity is subject to mandatory licensing) and documents confirming compliance with the requirements for a potential participant established by the technical specification;

for legal entities:

- a copy of the certificate or certificate of state registration (re-registration) of a legal entity;

- a copy of the document on the appointment (election) of the first head of the legal entity - participant in the competition;

- a copy of a certificate on the absence of tax debts and debts on mandatory pension contributions and social contributions for more than three months (except for cases when the payment deadline is deferred in accordance with the legislation of the Republic of Kazakhstan on taxes and other mandatory payments to the budget), issued no earlier than one the month preceding the date of opening the envelopes with competitive bids;

- a copy of permits/licenses for the target type of activity at the facility (if this type of activity is subject to mandatory licensing).

Foreign legal entities submit the same documents provided for by this subparagraph as legal entities - residents of the Republic of Kazakhstan, or documents containing similar information with a notarized translation in the state and/or Russian languages.

9.2. Additional required documents:

1) a schedule of current repairs and equipment (containing information on the timing of each stage and the financing of each stage, starting from the date of signing the property lease agreement with the University) signed by an authorized person and stamped - the original;

2) technical specification signed by an authorized person and stamped - the original;

3) project design;

4) estimate documentation.

10. Requirements for filling out an application for participation in the competition and the documents attached to it:

10.1 Applications are accepted on paper in sealed envelopes with a seal.

10.2 Applications and documents attached to them submitted in envelopes that are not sealed and not sealed by the participant of the competition will not be accepted.
10.3. The documents specified in paragraph 9 of this Announcement must be numbered, stitched, sealed and signed by a potential investor or an authorized person.

10.4 Applications for participation in the Tender and documents attached to it that do not meet the requirements specified in this Announcement and tender documentation are subject to rejection upon opening and do not participate in the Tender.

10.5. Conditions for the presence of representatives of the participants of the competition when opening applications for participation in the competition (envelopes submitted by participants):
10.5.1. Participants of the competition represented by authorized representatives have the right to be present at the opening of applications for participation in the competition, subject to the presentation of an identity document, a power of attorney to represent the interests of the participant or a document confirming the appointment of the first head of the participant.

10.6. In order to be present at the opening of applications for participation in the competition (envelopes submitted by participants), it is necessary to appear in advance (from 10:00 a.m. to 11:00 a.m. on July 04, 2023) and present an identity card, a power of attorney or a document confirming the appointment to the position to the secretary of the competition commission the first head of the participant.
